Bran Nue Dae

  1. Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.
  2. Entry is only open to Australian residents currently residing in Australia ("Eligible Entrants"). In the event an Eligible Entrant is under the age of 13 years, they must obtain their parents or guardians consent to enter and any prize will be awarded to that entrant's parent or guardian. The parent or guardian may be called to verify consent and may be required to sign a release at the discretion of the Promoter. The release will also require the winner's parent or guardian to accept responsibility for the acts and forbearances of the winner. The release must include the full name, address and telephone number of the winner's legal guardian. Failure to provide such proof, particulars or releases will immediately invalidate the winner's entitlement to the prize, subject to State and Territory legislation.
  3. Winners under the age of 15 must be accompanied by a parent or legal guardian to films rated M or MA15+. Failure to comply is not the fault of the Promoter (Roadshow Films), and is the sole responsibility of the winner.
  4. There is a limit of one race account per entrant. Roadshow Films reserves the right to disqualify any entrant that fails to comply with this restriction.
  5. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  6. Incomplete or indecipherable entries will be deemed invalid.
  7. The Promoter highly recommends a current residential street address be provided when requested for ease of correspondence and potential prize delivery. The Promoter makes all reasonable efforts to deliver prizes to the addresses provided by competition entrants. The Promoter cannot guarantee that any prizes returned to the Promoter due to non-delivery at the provided address will be re-sent to the prize winner
  8. Promotion commences at 12.00pm AEDST 11/12/2009 and entries close at 12.00pm AEDST 22/01/2010 ("the Promotion Period").
  9. Roadshow Films reserves the right to close the competition earlier than advertised and winners will be based on scores submitted to the time of the competition closing.
  10. To enter, Eligible Entrants must during the Promotional Period:
    1. Go to http://brannuedaemovie.com/race and complete in full the entry form including full name, email address and postal address.
    2. Play the Race to Broome Game ("Game") and submit the point scores from the Game.
  11. 1st Prize:
    The first Eligible Entrant to reach Broome within the game will receive a Private Gold Class movie screening for 21 people including the winner valued at RRP $798.00. In the event no player reaches Broome, the Eligible Entrant who has submitted the highest score during the Promotional Period will be awarded 1st prize. If more than one Eligible Entrant has submitted the same score at the end of the Promotional Period, then the Eligible Entrant who joined the race first will be the winner. The winner will be notified by telephone and email.

    1st Runners Up:
    2 double Gold Class cinema passes valued at RRP $76.00 each will be awarded to the Eligible Entrants who have submitted the 2nd and 3rd highest scores during the Promotional Period. If more than one Eligible Entrant has submitted the same score at the end of the Promotional Period, then the Eligible Entrant who joined the race first will be the winner. The winners will be notified by telephone and email.

    Weekly Winner:
    Competition comprises of 6 rounds over the Promotional Period. Round promotional periods are as follows (all times are AEDST):
    Round 112pm (noon) 11/12/2009 to 11.59:59am 18/12/2009
    Round 212pm 18/12/2009 to 11.59:59am 25/12/2009
    Round 312pm 25/12/2009 to 11.59:59am 1/01/2010

    For each of the 6 weekly rounds of the Promotion, 1 double Gold Class cinema passes valued at RRP $76.00 each will be awarded to the Eligible Entrant who has submitted the highest score during that round. If more than one Eligible Entrant has submitted the same score during that round, then the Eligible Entrant who joined the race first will be the winner. The winners will be notified by telephone and email.

    Daily Winner:
    The first Eligible Entrant to locate the daily hidden item within the game will receive a double cinema pass to the Bran Nue Dae movie valued at RRP$33.00 and a Bran Nue Dae sound track valued at RRP$30. The winners will be notified by email.

    The first Eligible Entrant to locate the additional bonus hidden item within the game will receive a double cinema pass to the Bran Nue Dae movie valued at RRP$33.00 and a signed Bran Nue Dae poster. The winners will be notified by email.

  12. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner's entry is of a type described in this clause. The promoter will not be required to provide proof for the disqualifications and will not enter into correspondence with the disqualified entrants.
  13. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions, network congestion or for any other reason.
  14. The cost of accessing the promotional website will be dependant on the entrant's individual Internet Service Provider.
  15. Gold Class screenings must be taken on a Monday or Wednesday and are subject to availability.
    All prizes must be taken as offered and are not exchangeable, transferable, redeemable for cash or able to be taken at another cinema in part or in whole.
    Private screening tickets may not be resold, exchanged for cash or cinema tickets.
  16. Legal aged consumers should be advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Alcohol Guidelines that are: Males: Up to 4 standard drinks on anyone day, no more than 5 days a week Females: Up to 2 standard drinks on any one day, no more than 5 days a week The total volume of alcohol awarded in this promotion will not exceed 20L for NSW residents.The service of alcohol is subject to relevant state legislation, including the ban of service of alcohol to persons under 18 years of age.
  17. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
  18. The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
  19. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
  20. In consideration for the Promoter awarding the prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner's participation in any aspect of the prize (Works). The winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.
  21. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
  22. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
  23. Should an entrant's contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
  24. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter's ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
  25. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
  26. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  27. Roadshow Films, and its associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
  28. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.
  29. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent.
  30. All entries become the property of The Promoter. All opt-in entries will be entered into a database and The Promoter may use the entrant's names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant. By opting-in, entrants confirm that they allow their details to be used for this purpose. If entrants no longer consent to their details being used for future marketing purposes, the entrant should contact The Promoter. Details for Roadshow Films are set out below. Any request to update, modify or delete the entrant's details should be directed to The Promoter.
  31. The promoter is Roadshow Films Pty Ltd, 1 Garden St, Melbourne VIC 3141 (ABN: 28 100 746 870) (the "Promoter").
  32. The Prize must be taken on the date and at the time specified by the Promoter (please note this will be within 3 months of the prize draw). If the winner is unable to attend the private screening on the date and at the time specified by the Promoter the winner must notify the Promoter who may in their absolute discretion nominate another time if reasonably practicable. Alternatively, the winner may choose to nominate a representative to attend on their behalf.
    The Prize must be taken at a location nominated by the Promoter.
    All prizes must be taken as offered and are not exchangeable, transferable, redeemable for cash or able to be taken at another cinema in part or in whole. Private screening tickets may not be resold, exchanged for cash or cinema tickets.
    No extension of the validity date of this prize will be permitted.
